A Thai Work Permit (ใบอนุญาตทำงาน) is the statutory authorisation that allows a non-Thai national to lawfully perform any activity — paid or unpaid — for an employer in Thailand. It is regulated by the Royal Decree on Foreign Workers' Employment Management B.E. 2560 (2017) and administered by the Department of Employment under the Ministry of Labour. Working in Thailand without a valid permit exposes the worker to a fine of up to THB 50,000 and immediate deportation, and exposes the employer to a fine of up to THB 100,000 per worker per offence.

Thai Notary Law coordinates the entire Work Permit lifecycle — from non-immigrant visa preparation, employer documentation, notarisation and MFA legalisation of foreign documents, BOI / Smart Visa channels, through to the permit application, in-person collection at the One Stop Service Centre, and the annual renewal cycle. The current Work Permit regime is governed primarily by the Royal Decree on Foreign Workers' Employment Management B.E. 2560 (2017), as amended in 2018, together with Ministerial Regulations issued by the Ministry of Labour. The Royal Decree consolidated several earlier statutes and significantly increased penalties on both employers and workers. It also defined 40 occupations that are statutorily reserved for Thai nationals — foreign nationals cannot obtain a Work Permit for any of these occupations regardless of qualification.

Every Work Permit must be matched to a specific employer, a specific job description and a specific physical location. Moving employer, changing job duties or relocating to a different province without an amendment is a separate offence. The end-to-end Work Permit chain

Most rejections we see come from clients trying to file the Work Permit application before the supporting documents are notarised, translated and legalised. The Work Permit chain runs in parallel with the visa chain, but it has its own document set and its own deadlines.

Ordinary WP vs BOI One Stop vs Smart Visa — which channel fits you?

The ordinary Work Permit channel is open to any registered Thai company that meets the THB 2 million paid-up capital and 4-Thais-per-foreigner ratio. Turnaround is 7 to 10 working days at the Department of Employment after the file is complete, and the permit is co-terminus with the Non-B visa. This is the right channel for most SMEs that do not qualify for BOI promotion.

The BOI channel is reserved for companies that hold a Board of Investment promotion certificate or qualify under specific BOI categories. Filing is done through the BOI e-Expert online system; turnaround is 3 working days for approval and a same-day Work Permit collection at the One Stop Service Centre. Capital and Thai-staff ratios are relaxed or waived. Fees are higher, but for technology, R&D and EEC investors the speed and flexibility usually justify the cost.

Smart Visa categories T (Talent), I (Investor), E (Executive), S (Startup) and O (dependents) combine the visa and Work Permit in a single 4-year, multi-entry endorsement. There is no 90-day reporting and no Work Permit book — a Smart Visa stamp in the passport is itself the work authorisation. The qualifying agency varies by category: DEPA for T digital, NIA for S startup, BOI / NSTDA for T science, NSTDA for E executive, and so on. We pre-screen eligibility and prepare the qualification dossier before any application is filed.

Pricing — what a complete Work Permit engagement costs

We quote in fixed-fee packages so there are no surprise top-ups. Government fees are paid through us at cost and itemised on the invoice. A typical end-to-end engagement (visa abroad → notarisation → translation → Work Permit → collection) for an ordinary employment case is THB 35,000–55,000 in professional fees plus THB 6,000–10,000 in government fees per applicant. BOI cases run THB 45,000–70,000 professional plus THB 4,000–6,000 government fees, with significantly faster turnaround.

Smart Visa engagements are quoted per category because the qualifying agency dossier varies in complexity; budget THB 70,000–150,000 professional plus the agency endorsement and visa fees. Add-ons such as dependent visas, accompanying spouse Work Permit, school enrolment letters and Yellow Book / Pink Card registration are quoted on a flat-fee menu.

The mistakes that most often trigger rejection or fines

  • Working under a tourist visa or visa exemption — even attending a one-day meeting can be cited
  • Foreign degree submitted without country-side notarisation and Thai embassy legalisation (or Apostille post-2025)

  • Job description on the application differing from the actual work performed, exposing both worker and employer at inspection

Detailed FAQ for foreign workers and HR teams

Can I start working as soon as I receive the Non-B visa?

No. The Non-B visa allows you to enter Thailand for the purpose of working, but you must hold the Work Permit book before performing any work. Working in the interval — even unpaid orientation — is a statutory offence. We schedule the WP filing so that the gap between entry and permit issuance is typically 5 to 10 days, during which only paid leave / onboarding without work output is permitted.

Does the 4-Thais-per-foreigner ratio apply to BOI companies?

Generally no. BOI-promoted companies are usually exempt from the THB 2 million capital per foreigner rule and the 4:1 Thai staff ratio for the foreign roles approved under their promotion certificate. For ordinary employment outside the BOI promotion, the ratio still applies.

Can my spouse work on a dependent Non-O visa?

Not without their own Work Permit. The dependent Non-O allows residence; the spouse must apply for a separate Work Permit (which requires a separate Non-B if they wish to work for a different employer, or a conversion if they will join the principal's employer).

Is remote work for a foreign employer covered?

Thai law is being clarified on digital nomad work. Under the current Royal Decree, remote work performed physically inside Thailand for any employer — Thai or foreign — technically requires a Work Permit. The new DTV (Destination Thailand Visa, 2024) and Smart Visa T provide compliant channels for this scenario.

How long does the Apostille for a foreign degree take after Thailand joined HCCH?

Apostille turnaround depends entirely on the issuing country. For US, UK, EU, Japan and Australia we typically see 5 to 15 working days door-to-door. Until the originating country issues the Apostille, the document cannot be used in Thailand even with our translation.

Can I change employer without leaving Thailand?

Yes — since 2017 you can change employer without re-applying for the visa abroad, provided the new employer is eligible and you transition within the statutory grace period (typically 15 days from termination).
