In a Thai criminal case, the decisive moments usually happen in the first hours at the police station, not at trial. This page explains the rights of a suspect under the Criminal Procedure Code and the Constitution, how provisional release works, and the sequence from investigation to the Supreme Court.

Criminal cases differ from civil cases in the burden of proof: the prosecution must prove guilt beyond reasonable doubt, and where the evidence leaves doubt, the benefit of that doubt goes to the accused. Understanding this before you decide how to answer at the investigation stage matters enormously.
The most common mistake is giving a statement without counsel, in the belief that a frank explanation will end matters quickly. In practice the recorded statement stays in the file for the life of the case and is very hard to walk back.
Below: statutory rights, the procedural sequence, bail and security, issues specific to foreign nationals, and appeals. We do not publish fees — ask by phone, LINE or email — and we never guarantee an outcome.

Issues specific to foreign nationals
I have been summoned but not arrested. Must I attend?
If the summons is lawful, attend on the appointed date with counsel. Ignoring a summons without good cause can lead to an application for an arrest warrant.
Should I give a statement to the police?
Only after taking legal advice. A suspect has the right to remain silent, and whatever is recorded stays in the file for the life of the case.
How long does bail take?
With documents and security ready, a decision is often made the same day within office hours, but it depends on the charge, judicial discretion and the time of filing.
What if I have no assets for security?
An employer's letter, a surety bond from an insurance company, or an application for release without security supported by reasons may be considered. It remains at the court's discretion.
Can a criminal case be settled?
Only compoundable offences may be settled. Offences against the state cannot be compounded, although compensation to the victim can be a mitigating factor.
What is the deadline to appeal?
Generally one month from the date the judgment is read, with an extension available on application where there is good cause.
Do you appear outside Bangkok?
Yes, in courts nationwide. Travel costs and scope are confirmed in writing before work begins.
Can you guarantee I will not be imprisoned?
No. Guaranteeing an outcome breaches the rules of professional conduct for Thai lawyers. We give a candid assessment based on the actual evidence and conduct the defence diligently.
Answers written from real files: what to prepare, who certifies what, and business-day estimates.
A suspect has the right to be told the allegation, the right to remain silent, the right to meet and consult a lawyer privately, the right to have counsel present during interrogation, the right to an interpreter if they do not understand Thai, and the right to inform relatives or their embassy. Use the interpreter and lawyer rights from the investigation stage, because those statements are later relied on in court.
Cash, a bank passbook with a bank confirmation letter, a land title deed with a valuation, a surety bond from an insurance company, or a qualifying person acting as surety under the court's criteria. The decision depends on the gravity of the charge, the circumstances and flight risk. Foreign applicants should also prepare evidence of their Thai address and employment.
Do not ignore it, because non-attendance can lead to an application for an arrest warrant. Check whether the summons names the allegation and whether the person attends as a witness or as an accused, and request a new date if there is a genuine reason. Attend with a lawyer from the first interview, since statements at the investigation stage are relied on later in court.
Compoundable offences, such as certain personal offences including defamation, end when the injured person validly withdraws the complaint or a lawful settlement is reached. Offences against the state proceed regardless of the victim's wishes. Compensation in the second category does not stop the case, but the court may treat it as a mitigating circumstance when considering sentence.
The right to an interpreter during investigation and trial, the right to meet and consult a lawyer privately, the right to have their embassy notified, and the right to apply for provisional release. Interpretation quality matters enormously, because wording recorded inaccurately during the investigation is routinely relied on at trial and is far harder to correct later than to challenge at the time.
No. Compoundable offences such as defamation and certain fraud categories can end through withdrawal of the complaint or a settlement agreement. Non-compoundable offences against the state continue regardless of whether the injured party wishes to proceed, although compensation paid to the victim is normally taken into account by the court when determining the sentence.
An arrested person has the right to have a relative or trusted person informed of the arrest and place of detention without delay, and a foreign national should ask for consular notification at the very first opportunity. An embassy cannot end the case, but it can assist with visits, lists of lawyers and contact with family at home.
A suspect may give a statement or decline to, and anything said may be used as evidence at trial. There is also a right to meet and consult a lawyer privately before deciding. In practice, read every line of the record before signing, ask for inaccurate wording to be corrected on the spot, and never sign a document you cannot read.
Where a party or witness does not understand Thai sufficiently, the court arranges an interpreter for the hearing. Flag the need and the exact language or dialect well in advance and brief the interpreter on case-specific vocabulary beforehand. Mistranslated testimony is a common ground of dispute on appeal, so accuracy at first instance is worth the preparation.
In practice cash, a passbook with a bank confirmation of balance, a land title deed with an appraisal, a bank or insurance guarantee, and in some cases the applicant's official position may be accepted. Security is released when the case becomes final or when the court revokes the bail undertaking; breach of the undertaking can lead to forfeiture.
It can be pursued both ways: criminally, aimed at punishment and subject to the short limitation period that applies to compoundable offences, and civilly, aimed at damages. Either route rewards fast evidence collection — timestamped screenshots with URLs, witnesses who saw the statement, and measurable impact. Truth published for the public benefit is a central defence.
A complaint hands evidence-gathering to the investigating officer, with the public prosecutor deciding whether to charge. A victim may also prosecute directly, in which case the court holds a preliminary hearing on whether the case has merit. The first route reduces the victim's evidential burden; the second gives more control over timing. The choice depends on how complete your evidence already is.
As a rule an appeal must be filed within one month from the date the judgment is read or deemed read, with extensions available at the court's discretion where there is good cause. Request the certified judgment and the record of proceedings immediately after the hearing — time spent waiting on paperwork comes out of the same one-month window.
Records of having been charged may remain in the relevant agencies' databases even where the outcome was an acquittal. A police clearance certificate from the Special Branch Bureau reflects that agency's own criteria. Keep the certified judgment and confirmation that the case is final so you can explain the entry to an employer or a destination immigration authority.
It depends on your bail conditions. The court may prohibit departure and require your passport to be deposited. If travel is genuinely necessary, an application with reasons and itinerary evidence must be filed and granted first. Leaving without permission risks revocation of bail and forfeiture of the security, so read the bail undertaking before booking flights.
Establish first whether the record sits with the national police database or with immigration, because they are corrected through different channels. Assemble a certified copy of the judgment or non-prosecution order, proof of any fine paid, and identity documents, then apply to the agency holding the record. Review times vary case by case and no agency outcome can be guaranteed.
A cheque offence targets issuing a cheque without sufficient funds under specific legislation. Fraud requires proving deceptive intent existing before the property was obtained. Practically, the evidence differs: cheque cases turn on bank records, while fraud turns on conversations, representations and money trails. Choosing the wrong basis at the outset wastes months and can affect limitation.
Yes, if provenance and completeness are credible. Preserve material from the source device with timestamps, record how it was obtained, and avoid partial or edited captures. Data held by an overseas provider may need to be requested through mutual legal assistance channels, and any provider certificate must carry a certified translation before it is tendered in court.
Yes. A victim may file a claim for compensation within the criminal proceedings brought by the public prosecutor, which saves the time and cost of a separate civil action. File the itemised loss and supporting evidence at the outset, because adding heads of claim after witness examination has begun is usually restricted.
An international police alert is an information notice between police agencies, not a binding arrest order in itself. Extradition is a separate judicial process under a treaty or reciprocity, requiring a complete case file with certified translations and diplomatic-channel authentication. A person affected can contest the request or apply through the available mechanisms to have the alert data reviewed or deleted.
With a suspended sentence the court fixes the penalty but suspends its execution for a set period. With deferred punishment no penalty is fixed at all. Both usually carry probation conditions such as reporting or community service. Breaching a condition or reoffending within the period allows the court to activate the suspended penalty alongside the new case.
Have them authenticated in the issuing country first, then translated into Thai with a certified translation naming the translator and confirming accuracy, then legalised through the applicable channel — currently the Department of Consular Affairs plus the relevant embassy. From 28 February 2027, documents from Hague Convention states can carry an Apostille instead of the embassy step. Allow several tens of working days.
As a general rule the appeal must be filed within one month of the judgment being read, and the court may grant an extension where there is good cause. Preparation means obtaining the judgment, the record of proceedings and the witness testimony, then identifying the specific points of law or fact being challenged. For a foreign defendant, arrange the interpreter and translations early — the window is short.
Compoundable offences — including defamation and certain fraud situations — end when the injured person withdraws the complaint or the parties settle. For non-compoundable offences the public prosecutor can proceed even if the injured party no longer wishes to pursue it, although compensation is generally taken into account in sentencing. Always record any settlement in writing and keep signed copies.
The first step is to have a lawyer verify the warrant's status and the underlying charge with the court and the investigating station. Then weigh the options: surrender with bail security prepared, or file the appropriate application with the court. Entering the country without preparation can lead to detention at immigration. A power of attorney authorising the lawyer to act should be signed before a notary public and legalised before it is sent.
Records of proceedings are held by the relevant agencies, and whether they appear depends on the regulations and the type of certificate requested. Where a case was dismissed or a non-prosecution order was issued, keep a certified copy of that judgment or order: embassies and foreign employers frequently ask for supporting documents, and those must be accompanied by a certified translation.
The interpreter must render testimony completely and accurately, without summarising or offering opinions, and takes an oath before the court prior to acting. In practice, use an interpreter familiar with legal vocabulary and courtroom procedure, and tell the court in advance about any regional dialect. Any foreign-language document in the case file must be filed together with a Thai translation.
File the complaint with the investigating officer in the district where the offence occurred, bringing a passport, evidence of the loss and Thai translations of any foreign documents. For compoundable offences the complaint must generally be made within three months of learning of the offence and the offender's identity. If you must travel home, a lawyer can act under a power of attorney legalised as the investigating officer requires.
A person who does not understand Thai is entitled to an interpreter during investigation and in court. Giving a statement without an interpreter both sides understand is the main reason early statements later conflict with the facts, and that conflict is very hard to undo at trial. Before signing any record, have your lawyer and interpreter read it back line by line, and keep a signed copy.
Commonly cash, a bank passbook with a bank confirmation of balance, a land title deed with a valuation, or a surety bond from an insurance company. The court weighs the gravity of the charge, flight risk and the reliability of the security together. Prepare evidence of your address and ties to Thailand as well, because those genuinely inform the court's discretion.
Being charged does not automatically end your permission to stay, but the outcome and any bail conditions can restrict travel and complicate extensions. Case documents are frequently requested during those reviews, so keep copies of orders, judgments and fine receipts. If they are needed abroad, they require certified translation and the legalisation chain the destination prescribes.
The check draws on Royal Thai Police records. Where a court dismissed the case or it concluded without a finding of guilt, it should not appear as a criminal record. If the database has not been updated, a correction request supported by a certified copy of the judgment may be needed. Run the check well before your destination deadline, because corrections take weeks.
