A Thai civil case turns on four questions: what is the cause of action, where is the evidence, how much of the limitation period is left, and what assets can actually be seized after judgment. This page sets out the sequence under the Civil Procedure Code so you can assess a claim before filing.

Thai civil litigation is not a moral contest. It is proof of facts through admissible evidence, inside a limitation period and before a court with jurisdiction. Many claimants with strong facts lose because their documents are scattered or because they waited until the limitation period was almost exhausted.
Enforcement is the step most often ignored. A judgment against a debtor with no traceable assets is paper. Asset tracing, and where justified an application for provisional measures before judgment, matter as much as the drafting of the complaint.
Below you will find the case types we handle, the procedural sequence, the limitation periods to check first, the court-side costs and the documentary work required of foreign parties. We do not publish fees, because scope varies widely; ask by phone, LINE or email.

Foreign parties and foreign documents
Which court hears my case?
Generally the court where the defendant is domiciled or where the cause of action arose, under the Civil Procedure Code. A jurisdiction clause in the contract is taken into account by the court.
How long does a civil case take?
It depends on complexity, the number of witnesses and the court's caseload. First-instance cases commonly run several months to over a year, and appeals extend that further.
Can I sue without a written contract?
Often yes, because many contracts need no writing. Some matters, such as loans above the statutory threshold, require written evidence to be enforceable in court, so preserve chats, receipts and transfer records.
Can we still settle after filing?
Yes. Thai courts actively promote mediation before and during proceedings, and a settlement can be entered as a judgment by consent, enforceable like any judgment.
Do I get paid immediately after winning?
No. The judgment must become enforceable, then assets are traced and seizure or attachment is applied for through the Legal Execution Department. Timing depends on whether the debtor holds assets.
Can assets be frozen before judgment?
Provisional measures before judgment are available under the Civil Procedure Code where the statutory conditions are met. Strong grounds are required and security for damages may be ordered.
How are your fees set?
By amount in dispute, complexity, number of hearings and the court involved. Scope and fees are confirmed in writing before work starts — ask by phone, LINE or email.
Can you guarantee a win?
No. Guaranteeing an outcome breaches the Lawyers Council of Thailand's rules of professional conduct. What we offer is a candid risk assessment and diligent conduct of the case.
Answers written from real files: what to prepare, who certifies what, and business-day estimates.
It can be used in evidence, but Thai courts conduct proceedings in Thai, so foreign-language documents must be filed with a Thai translation, and the court often requires the translator to certify or attest to its accuracy. Agree a shared glossary with the counterparty early: disputes about what a translated clause means are a common and avoidable cause of delay.
As a rule, no. Thailand has no general statute providing for the recognition and enforcement of foreign judgments, so in practice a claimant usually has to bring a fresh action in the Thai courts and use the foreign judgment as significant evidence. The foreign case papers will need Thai translations and the authentication the court requires before they can be admitted.
They vary by the type of claim. General contractual debts carry a ten-year period, while certain claims for wages or the price of goods are considerably shorter. Tort claims are generally one year from when the injured party knew of the wrongful act and the person liable, and in no case more than ten years from the act. Misreading the start date is the most frequent cause of lost rights.
It can, but documents filed with a Thai court require an accurate and complete Thai translation, and the opposing party may challenge that translation. The better practice is to state in the contract which language version governs and to prepare a certified translation at signing. Translations produced only after a dispute begins invite arguments about wording that could have been avoided.
General contractual claims carry a ten-year limitation period unless a specific rule says otherwise, while certain categories are far shorter, including some trade receivables and particular wage claims. Partial payment or a written acknowledgement of the debt interrupts the period, which then restarts. Confirm the category early, because filing even one day late extinguishes the right to sue.
It is admissible as evidence, but a Thai translation must be filed alongside it under the court's rules. The translation should name the translator and carry a statement of accuracy. Contracts should also state from the outset which language version prevails in the event of conflict; omitting that clause creates a secondary dispute that lengthens the main case unnecessarily.
A final judgment still needs separate enforcement. The judgment creditor applies for a writ of execution, appoints the execution officer and then has to locate assets — bank accounts, land, vehicles or receivables owed by third parties — before seizure or garnishment can begin. Timing depends on asset tracing, not on the judgment itself, so keep financial-trail evidence from before filing.
The instrument should spell out authority to sue, defend, settle and receive funds. When signed outside Thailand, the receiving party usually expects the signature to be certified by a notary in that country and then legalised through the Thai embassy or another route the recipient accepts, with a certified Thai translation attached. Spelling must match the passport exactly.
Where a valid arbitration agreement exists, a defendant can ask the court to stay or strike the case so the dispute proceeds to arbitration. Review the clause before filing anything: institution, seat, language and applicable rules. Starting in the wrong forum costs months and filing expense, and can weaken your position on interim relief.
The Electronic Transactions Act provides that a message or signature cannot be denied legal effect merely because it is electronic. Evidential weight turns on how reliably the signer was identified and how document integrity was preserved, so retain the audit trail, confirmation emails and original files. Certain transactions for which the law prescribes a specific form still require paper.
Consumer procedure is designed for easier access: a claim can be filed orally with a court officer's help drafting it, and mediation is emphasised early. For some issues concerning production or service processes, the burden of proof may fall on the business operator. Classifying the case correctly at the outset avoids amending pleadings later.
Attach a Thai translation with the translator's certificate of accuracy, and expect the opposing party to test whether the source document went through the correct certification chain. File them as facing pairs — source and translation under one exhibit number — and be ready to call a witness who can speak to how the document was created.
When the parties agree and the court enters judgment in accordance with the compromise, the settlement carries the force of a judgment. A defaulting party can be subjected to execution immediately, with no new lawsuit. Because of that, payment amounts, due dates, default interest and the consequence of missing any single instalment must be written precisely before signing.
The starting point is separation: a company is a distinct legal person and directors are not automatically liable. Personal exposure arises where a director personally guaranteed the obligation, acted dishonestly or with gross negligence, or where a specific statute imposes liability, as in certain tax situations. Keeping company and personal accounts strictly separate matters a great deal.
Check whether statutory advance notice was given or paid in lieu, then calculate your length of service to establish the severance tier. Test whether the employer's stated ground is actually supported by evidence such as written warnings. Keep the employment contract, payslips, warning letters and instruction messages. Labour claims run on shorter deadlines than ordinary civil claims, so take advice within the first few weeks.
You can apply for interim protection before judgment to freeze or restrain dealings with specific assets. The application must show evidence that enforcement is being made harder, and security for potential damage is normally required. A separate route is an action to set aside transactions that prejudice creditors. Both work best early, because each further transfer makes recovery more complex.
Yes. A lease of immovable property exceeding three years must be registered with the competent official, otherwise it is enforceable for three years only. Tenants investing heavily in fit-out should register and confirm the landlord is the registered title holder. Where the tenant signs from abroad, execute before a notary public there and have the signature legalised before the document is used in Thailand.
Confirm your rights first: a Thai trade mark registration, or evidence of authorship for copyright. Then capture the infringement systematically with dates and sources. A cease-and-desist letter usually precedes proceedings in the Intellectual Property and International Trade Court. Foreign registration certificates need certified translations and the appropriate legalisation layer before they can be filed as evidence.
Rehabilitation keeps the business trading under a plan approved by creditors and the court, with an automatic stay protecting it during the process. Bankruptcy leads to collection and distribution of assets to creditors. A business with continuing revenue and going-concern value usually benefits more from rehabilitation. Base the decision on real cash-flow forecasts rather than the headline debt figure.
Filing fees are assessed on the amount claimed at statutory rates, with a cap for high-value claims. Service of process, expert witnesses and document translation are separate costs. A party without sufficient means may apply for a fee exemption. Weigh total projected cost against the realistic prospect of enforcing any judgment before deciding to sue.
Foreign nationals cannot hold land directly except in narrowly defined statutory cases. Using a Thai company with nominee shareholders is unlawful nominee holding and can be investigated retrospectively. Safer structures include a registered long-term lease, a registered superficies right, or condominium ownership within the permitted foreign quota. Have the structure reviewed before any money moves.
It often can, but the party relying on the foreign law must prove its content to the court, typically through expert opinion supported by a certified translation. If that proof fails, Thai law is usually applied instead. Any term contrary to Thai public order or good morals will not be enforced regardless of the governing-law clause.
The foreign decree or divorce certificate is translated into Thai, authenticated according to the issuing country's rules and legalised at the Department of Consular Affairs, then submitted to a district registrar to record the change of family status. Where jurisdiction or service of process is arguable, the registrar may ask for a Thai court order first. Make sure every document spells the names identically — mismatches are the most common reason files are returned.
A foreign heir can acquire rights in the estate, but foreign ownership of land is restricted under the Land Code. In practice the Land Department normally requires the land to be disposed of within a set period rather than registered permanently in the heir's name. A condominium unit can usually be retained if the building is still within its foreign-ownership quota, so check the quota with the juristic person before transfer.
It can, if it was validly executed and its authenticity can be proved, but it must be accompanied by a Thai translation and whatever authentication the court or Land Office requires. Many families find it simpler to make a separate Thai will covering only Thai assets, expressly stating that it does not revoke the foreign will — that wording prevents the two documents from cancelling each other.
A petition is filed with the court where the deceased was domiciled, supported by the death certificate, house registration, evidence of the heirs' relationship, a schedule of estate assets and consents from the other heirs. Timing depends on each court's hearing calendar and how complete the file is. Foreign documents such as death or marriage certificates must be legalised and translated before they can be used in evidence.
Confirm the project holds its permits and that the condominium has been registered, check the transfer date and the refund terms if construction is not completed, the remaining foreign-ownership quota, common-area fees and the sinking fund, and whether penalty clauses apply fairly to both sides. If the buyer is overseas and someone else will sign at transfer, the power of attorney must be signed before a notary public and legalised before it is returned.
Mediation is usually faster and cheaper and preserves the commercial relationship, and a settlement recorded in court is enforceable in the same way as a judgment. Litigation makes sense when the other side will not negotiate, when a precedent matters, or when a limitation period is about to expire. A common approach is to file to protect the claim and negotiate in parallel through the court's mediation process.
Whichever the governing-language clause designates. Without one, a Thai court examines the evidence of what the parties actually understood, which invites competing interpretations and lengthens the case. The safe practice is to state the controlling version explicitly, use one defined-term set across both languages, and have the translator work alongside the drafting lawyer rather than translating at the last moment before signing.
It normally needs a Thai translation with the translator's certification of accuracy, and the source document should be authenticated under the issuing country's system to reduce challenges to authenticity. The opposing party may dispute the translation, so translate every page including seals and signatures, and provide an index keyed to exhibit numbers so the court can verify quickly during examination.
It depends on the limitation period, the amount in dispute and the evidence already in hand. Where the file is complete and the counterparty has attachable assets, a demand letter with a firm deadline often resolves matters faster and is itself usable evidence later. Where limitation is near or assets may be moved, file and consider interim protective measures. We map the options and consequences before you decide.
Thailand has no automatic recognition and enforcement regime for foreign judgments, so as a rule a fresh action is filed in the Thai court, using the judgment as important evidence of the underlying obligation. Foreign arbitral awards follow a different route under the arbitration legislation. The dispute-resolution clause chosen at contract stage therefore has a large effect on real-world enforceability.
