A Statutory Declaration is a written statement that the Declarant solemnly affirms to be true, signed in person before a Notarial Services Attorney in Thailand. It is the most flexible instrument in the notarial toolkit — usable for almost any factual matter a foreign authority, bank, embassy or court needs you to attest. Unlike a Single Status Affidavit (which uses an embassy template), a Statutory Declaration has no fixed form, so risk lives in the **wording**: one ambiguous clause can be rejected by the receiving authority, or used as evidence against the Declarant later under Penal § 177.
The purposes we see most often: (a) **Name change / spelling variation** — passport doesn't match older documents (marriage, gender change, transliteration); (b) **Lost-document affidavit** — to replace a passport, visa or title deed; (c) **Parental consent for minor travel** under CCC § 1574 + ICAO Doc 9303 + Hague Convention 1980 (child-abduction prevention); (d) **De-facto / common-law relationship statement** for Subclass 309/820 (AU), Partnership Visa (NZ), Spousal Sponsorship (CA) — must specify cohabitation period, joint finances, social recognition; (e) **Income & source-of-funds statement** for immigration / mortgage / investment under AMLA CDD; (f) **Identity confirmation** for foreign banks — Wise, Revolut, HSBC, Standard Chartered accept an Apostilled notarial declaration instead of an in-branch visit.

Can a Thai Statutory Declaration be used in the UK / AU / NZ / CA?
Yes. A Notarial Services Attorney registered with the Lawyers Council of Thailand is a Notary Public within the meaning of HCCH Apostille Convention 1961 and most common-law statutes. Once MFA-Apostilled, the declaration is accepted in the UK, AU, NZ, CA, SG, HK and 130 contracting states.
How is it different from an Affidavit?
An Affidavit is sworn under oath (Oath of Office Act 2542), with stronger evidentiary weight and preferred in civil-law and court use. A Statutory Declaration is a solemn declaration used in common-law jurisdictions for out-of-court matters. In Thailand both are administered by Notarial Attorneys under Reg. 2546.
I already have a draft — can the attorney just sign it?
Yes, but we always review the wording first — ambiguous, off-format or potentially-false statements are rejected by receiving authorities and expose the declarant to Penal § 177. Review quote on request (phone / LINE / email) (credited if you use the full service).
Can I sign online or do I need to attend in person?
In person only. Reg. 2546 § 17 requires the Notarial Attorney to verify identity and witness the signature. Remote Online Notarization (RON) is not yet recognised in Thai law (unlike US Florida / Virginia). We have a Bangkok office plus a nationwide travel-notary service.
Can HCCH Apostille (entering into force for Thailand 28 February 2027) be used for a Statutory Declaration?
Yes — notarial acts are within Apostille scope under Article 1(c). Since 28 February 2027 the MFA issues Apostille in lieu of embassy legalization for the 130 contracting states, cutting turnaround 60–75%. Non-contracting states still require embassy legalization.
Child travelling alone — do both parents need to consent?
Yes, under CCC § 1574 + ICAO Doc 9303 + Hague 1980 (child abduction prevention). Exceptions: (a) sole-custody court order, (b) the other parent is deceased (apostilled death certificate), (c) the other parent's whereabouts are unknown after lawful search. We will pick the safest lawful path under both Thai and destination law.
What goes into a de-facto relationship declaration for an Australian Partner Visa?
(1) Cohabitation start date + address; (2) Joint finances — bank statements, bills; (3) Social recognition — photos, third-party statements; (4) Mutual commitment — future plans, wills, beneficiaries. Each pillar must be evidenced. Don't overclaim — Australian DHA scrutinises under Migration Act § 4AA + Schedule 2 Reg. 1.15A.
What goes into a source-of-funds declaration?
(1) Origin (salary / business profit / inheritance / asset sale / gift); (2) Amount + currency; (3) Date received; (4) Payer; (5) Supporting documents (pay slip, tax return, sale contract, will). No vague language — AMLA + FATF Recommendation 10 + destination AML (UK MLR 2017, AU AML/CTF Act, EU 6AMLD) are very strict.
