CCC §§ 861–897 · OIC · York-Antwerp 2016 · ICC Cargo (A/B/C) · LOF 2020 · BoT SorNorChor 11/61 · HCCH (in force for Thailand 28 February 2027)
**Notary Public + insurance lawyer + marine surveyor + loss adjuster** for end-to-end notarisation of cross-border insurance-claim documents — **Proof of Loss (POL)**, **Sworn Statement in Proof of Loss (ACORD 4)**, **Subrogation Receipt + Release & Trust Receipt**, **Loss-Adjuster + survey report**, **Master's Protest + Sea Protest** (linked to N13), **Bill of Lading endorsement**, **Notice of Abandonment + claim bordereau**, **Lloyd's Open Form (LOF 2020) salvage agreement + SCOPIC**, **General Average Bond + guarantee (York-Antwerp 2016)**, **P&I Club Letter of Undertaking (LOU)**, **cargo survey affidavit**, **death-claim affidavit + beneficiary declaration** (health & life), **reinsurance cedant statement + treaty slip + scratch**, **OIC notification**, **BoT FX inbound claim payout**, with **HCCH Apostille** valid across 130 contracting states — **24–72 h, fixed-fee, no % of claim amount (Lawyers Council § 11)**.
**Why cross-border insurance claims must be notarised — insurers, reinsurers, P&I clubs and Lloyd's syndicates need anti-fraud evidence admissible in court / arbitration.** Global insurance loss ratio sits at 60–75%, with 10–15% insurance fraud (Coalition Against Insurance Fraud), so insurers demand documents passing **notarial attestation** for: (a) identity verification of claimant + witnesses; (b) anti-fraud declaration under oath (perjury under Criminal Code § 137 + insurance fraud); (c) hash anchor of damage photos / video (SHA-256 + RFC 3161 time-stamp) preventing post-hoc manipulation; (d) court / arbitration evidence under IBA Rules on Taking of Evidence in International Arbitration 2020 Art. 3.12 (electronic document authenticity). Unnotarised documents = insurer refusal + time-bar expiry under CCC § 882 (2-year insurance / 2-year marine cargo) = forfeited claim.
**Thai insurance regime vs international — why OIC demands notarisation on cross-border claims.** Thai insurance is regulated by the **Office of Insurance Commission (OIC)** under the Non-Life Insurance Act B.E. 2535 + Life Insurance Act B.E. 2535. Foreign insurers underwriting Thai risk must either (i) register as a branch with OIC (Tokio Marine, MSIG, Allianz, AXA, Chubb, AIG), or (ii) cross-border reinsure through a Thai cedant (Munich Re, Swiss Re, Lloyd's syndicates). On a cross-border claim, documents flow Thai notary → MFA Apostille → underwriter / reinsurer abroad → loss adjustment + reinsurance recovery. OIC Notifications 2566 / 2567 mandate **ISO 17442 LEI** for insurers / cedants + AML/CFT screening under AMLA § 22.
**CCC §§ 861–897 — Thai insurance contract framework.** Divided into (a) §§ 861–868 general provisions (aleatory contract + insurable interest + utmost good faith / Uberrimae Fidei); (b) §§ 869–882 indemnity insurance (non-life + marine) — subrogation under § 880 + 2-year time-bar under § 882; (c) §§ 883–897 life insurance — beneficiary designation § 891 + suicide clause 1 year + contestability 2 years. The Marine Insurance Act 2535 supplements the CCC across hull + cargo + freight + P&I + war risk. The notary checks (i) insurable interest at the time of loss; (ii) utmost good-faith disclosure of every material fact; (iii) proximate cause (Causa Proxima must be an insured peril); (iv) quantum (sum insured vs actual loss vs replacement cost vs agreed value).
**Proof of Loss (POL) + sworn statement in Proof of Loss (ACORD 4) — the central notarised document.** POL is an affidavit confirming under oath: (1) identity + policy number + loss date + place; (2) description of loss + cause + proximate peril; (3) schedule of property lost / damaged (sum insured, book value, replacement cost); (4) salvage value + other insurance (pro-rata contribution); (5) no fraud / no concealment declaration (false statement = claim denied + Criminal Code § 137); (6) subrogation acknowledgement (CCC § 880). ACORD Form 4 / 5 / 6 is the US / UK / Lloyd's / reinsurance standard. The notary attests (a) wet signature + identity of insured + witness; (b) date + place of signing; (c) authority verification where the signatory is a corporate officer (board resolution + specimen + POA); (d) Apostille for the foreign reinsurer. Turnaround 24 h; quote on request (phone / LINE / email).
**Subrogation receipt + release & trust receipt — transfer of rights under CCC § 880.** When the insurer pays, it automatically acquires the insured's rights against the tortfeasor / third party under CCC § 880 (subrogation by operation of law). In practice, the insurer demands a written subrogation receipt confirming receipt + transfer of rights + a release & trust receipt under which the insured holds any recovery in trust for the insurer and may not litigate independently. The notary attests (i) wet signature + identity; (ii) receipt amount + currency + bank account; (iii) scope of released claim (per-occurrence vs aggregate vs per-risk); (iv) reservation of rights (claims exceeding sum insured). Critical for marine cargo (vs carrier under Hague-Visby / Hamburg / Rotterdam Rules) + property (vs tortfeasor / contractor) + motor (vs at-fault driver / vehicle owner).
**Master's Protest + Sea Protest + Notice of Abandonment — marine insurance under Marine Insurance Act 2535.** On heavy weather / collision / grounding / fire the Master must lodge a Sea Protest within 24 h at the next port (notarised — linked to N13 Marine Protest). A Notice of Abandonment (NOA) applies on Constructive Total Loss (CTL) — repair cost > insured value × 75% — abandoning the vessel / cargo to the insurer in exchange for a total-loss payout + salvage right. Time-bar: NOA must be made 'with reasonable diligence' under Marine Insurance Act § 62 + ICC Cargo Clauses (A) Cl. 13. LOF 2020 (Lloyd's Open Form) + SCOPIC apply to emergency salvage — the Master signs with the salvor (Smit, Resolve, Donjon, Svitzer) under 'No Cure No Pay' + SCOPIC = Special Compensation P&I Club for environmental salvage. The notary attests (i) Master's signature + vessel authority; (ii) time + place + GPS coordinates; (iii) tidewater hash + ECDIS track anchor.
**General Average + York-Antwerp Rules 2016 — sacrificing property to save the common adventure.** General Average (GA) descends from Lex Rhodia (800 BC): when the Master sacrifices property (jettison, engine damage, salvage cost) to save the vessel + crew + cargo, all interests (hull + cargo + freight) share the burden in proportion to saved value. York-Antwerp Rules 2016 (Comité Maritime International) are the global standard, applied by Average Adjusters (Richards Hogg Lindley, Cunningham Lindsey, Charles Taylor, Marsh). Notarised documents include (a) General Average Bond (Lloyd's form) — cargo owner's promise to pay GA contribution; (b) General Average Guarantee from the cargo insurer; (c) GA deposit receipt where no insurance guarantee exists; (d) Average Adjuster's statement (6–24 months post-event). Recent precedents: Ever Given (Suez 2021) GA contribution USD 916M; MSC Napoli (2007) USD 50M.
**P&I Club Letter of Undertaking (LOU) — cash-security substitute to release an arrested ship.** When a vessel is arrested abroad (cargo damage / collision / pollution / crew injury / bunker spill), the owner must post security (USD 1M–50M per claim). An LOU from a P&I club (Gard, Steamship Mutual, North Standard, UK Club, Britannia, Skuld, West of England, American Club, Japan P&I, China P&I, Shipowners Mutual) substitutes cash — owner avoids the bond + court releases the ship. The notary attests (i) LOU issuance from an authorised signatory + specimen comparison; (ii) Apostille for the forum court (Singapore Admiralty, US District Court, English Admiralty, Rotterdam); (iii) sworn translation in the local language via an MoJ translator. LOU usually follows Club Form 1 + Standard Wording 2018. Cross-border arrest leverages the Arrest Convention 1999 (Thailand not yet party) — falls back on each jurisdiction's civil procedure.
**Beneficiary declaration + death-claim affidavit — life insurance under CCC §§ 883–897.** On death of the insured, the beneficiary files (1) death certificate (ThorRor.4/1 + Apostille if death abroad); (2) beneficiary declaration with relationship + bank account; (3) affidavit of identity + heirship (if no named beneficiary — intestate succession under CCC § 1629 — order: spouse + children → parents → full siblings → half-siblings → grandparents → uncles/aunts); (4) court order if there is a dispute (probate / civil). The notary attests (i) wet signature + identity for beneficiary + 2 witnesses; (ii) anti-fraud declaration (suicide 1-year clause + 2-year contestability under CCC § 895 + § 897); (iii) overseas beneficiary route via POA + Apostille → attorney-in-fact receives funds + Thai notary verifies specimen. Cross-border life claims usually need Apostille + sworn translation + inheritance tax clearance (RC § 65 ter (9)).
**Cargo survey + loss-adjuster report — independent evidence accepted by insurers / reinsurers.** Cargo surveys are performed by Lloyd's Agents or independent surveyors (SGS, Bureau Veritas, Cunningham Lindsey, McLarens, Crawford, Sedgwick, Charles Taylor, Matthews Daniel, Brookes Bell, Constellation Marine). Reports must cover (a) time + place + vessel + voyage; (b) cargo description + packing + marks; (c) cause of damage + proximate peril; (d) quantum (total / partial / constructive total loss); (e) photo + video + SHA-256 hash + GPS metadata; (f) salvage recommendation. The notary attests (i) surveyor's affidavit + Lloyd's Agent licence verification; (ii) photo / video hash anchor (RFC 3161 + blockchain OP_RETURN); (iii) chain of custody on samples (lab tests by Saybolt / Inspectorate / SGS); (iv) translation for the forum court. Used as evidence in LMAA / SCMA / SIAC / ICC arbitration.
**Reinsurance cedant statement + treaty slip + scratch — recovery from reinsurers.** When the insurer (cedant) pays a claim above retention, it recovers from reinsurers (Munich Re, Swiss Re, Hannover Re, SCOR, Lloyd's syndicates, RGA, PartnerRe, Everest Re, Korean Re, China Re, GIC India, Toa Re). Reinsurance comes in four flavours: (a) treaty proportional (quota share + surplus); (b) treaty non-proportional (XL + stop loss + cat XL); (c) facultative proportional; (d) facultative non-proportional. Notarised documents include (i) claim bordereau + loss run; (ii) cedant statement + reinsurer's scratch (Lloyd's slip); (iii) loss-adjuster report + underlying policy wording; (iv) reserves & run-off statement; (v) subrogation recovery account. Standards: ACORD Reinsurance + ASCII RDS. Reinsurance disputes typically arbitrate at ARIAS (US/UK), Lloyd's syndicate arbitration, SIAC or under the Bermuda Form.
**BoT FX + Revenue Code — when claim payouts enter Thailand from foreign insurers.** A foreign insurer / reinsurer / P&I club paying into Thailand in USD / EUR / GBP / JPY must clear (1) BoT FX via an authorised bank + Form Tor.Tor.40 (FDI > USD 50K) + Form ThorTor.3 (beneficiary declaration); (2) RC § 65 ter (9) — property indemnity is **not income** (capital replacement) so **no WHT**, except (a) loss of profit / BI = income → WHT 1–5%; (b) life death benefit = exempt (RC § 42(13)); (c) annuity payment = income → WHT 5%; (3) stamp duty: indemnity receipt > THB 200 = THB 1; (4) AML/CFT: AMLO reporting where payout > THB 2M cash or USD 50K wire (Form ปปง. 1-01). The notary attests (i) beneficiary declaration; (ii) source-of-fund affidavit; (iii) DTA tax clearance for cross-border flows; (iv) AML KYC pack.
**HCCH (in force for Thailand 28 February 2027) impact on insurance claims.** Since 28 February 2027, POL / survey reports / subrogation receipts / LOU / salvage agreements issued in Thailand are usable across 127 HCCH states immediately after Apostille — no embassy chains (previously USD 100–300 / doc + 2–4 weeks per country). A cross-border claim usually crosses 3–5 jurisdictions (insured + underwriter + reinsurer + salvor + beneficiary) × USD 200 ≈ USD 600–1,000, dropping to Apostille quote on request (phone / LINE / email) ≈ USD 22 / doc. Claim settlement collapses from 6–12 months to 2–6 months. Insurers / reinsurers in UK / DE / FR / NL / JP / KR / SG / HK / US / AU use the Apostille path 100% (Lloyd's, Munich Re, Swiss Re, Hannover Re, SCOR, AIG, Chubb, Allianz, AXA, Generali, Zurich, Tokio Marine, MSIG, Sompo, Mitsui Sumitomo).
**Fees + turnaround.** POL + sworn statement (ACORD 4) pack quote on request (phone / LINE / email) K / 24 h; subrogation receipt + release & trust receipt quoted on request K / 12 h; Master's Protest + Notice of Abandonment + Sea Protest quoted on request K / 24 h; LOF 2020 + SCOPIC salvage pack quoted on request K / 24–48 h; General Average Bond + guarantee pack quoted on request K / 48 h; P&I Club LOU pack quoted on request K / 24 h; cargo survey affidavit + photo / video hash anchor quoted on request K / 24 h; death-claim affidavit + beneficiary declaration pack (life) quoted on request K / 24 h; reinsurance cedant statement + treaty slip pack quoted on request K / 48 h. Apostille quoted on request / doc. Sworn translation (MoJ) quoted on request / page. PI insurance Lloyd's quoted on request M. **% of claim amount is forbidden** — Lawyers Council § 11.
**Retention + PDPA + AMLA.** Files kept **10 years** = (a) CCC § 193/30 (10-year general limitation); (b) CCC § 882 (2-year insurance limitation — counter-claim + subrogation may extend); (c) AMLA § 22 (5 years); (d) OIC retention (10 years); (e) RC § 87/3 (5 years for tax); (f) reinsurance treaty run-off (5–15 years — IBNR + late-reported claims). PDPA § 26 purpose-limitation. ISO 27001 + AES-256 + Singapore off-site backup + HSM. Disclosure only to insured / insurer / reinsurer / P&I club / salvage master / court or tribunal order. Photo / video hash anchor + survey report + LOF / SCOPIC salvage data retained **permanently** (blockchain anchor IPFS + Bitcoin OP_RETURN) — evidence for any future dispute (reinsurance recovery, subrogation vs carrier, cyber forensic, salvage award dispute).

**ใช่ — ทุกครั้งสำหรับ Cross-Border Claim และ Claim > สอบถามค่าบริการทางโทรศัพท์ / LINE / อีเมล K ในไทย** เพราะ Insurer / Reinsurer ต้องการ: (a) **Anti-Fraud Evidence** — POL ภายใต้คำสาบาน + Notarial Attestation = พยานหลักฐานในศาลที่ผิดได้ตาม อาญา § 137 (Perjury) + Insurance Fraud Act; (b) **Identity Verification** — Notary ตรวจ Passport/ID + Signature Specimen ป้องกัน Impersonation; (c) **Date Lock** — Notary Date-Stamp ป้องกัน Back-Dating; (d) **Reinsurance Recovery** — Reinsurer ต่างประเทศ (Munich Re, Swiss Re, Lloyd's) ต้องการ Notarised POL + Apostille เป็นเงื่อนไข Recovery; (e) **Arbitration Evidence** — IBA Rules 2020 Art. 3.12 ยอมรับ Notarised Document เป็น Authentic. Internal Adjuster + Self-Declaration
**Policy Standard Condition** (เช่น Marine Cargo ICC (A) Cl. 16, Property MR Wording Cl. 17, P&I Rule 19) บังคับว่า Insured ต้อง 'do all such things' รวม Subrogation Receipt → ถ้าไม่ทำ = Breach of Policy Condition + Insurer ปฏิเสธจ่าย. Notary รับรอง Receipt + ตรวจ Scope of Release + Reservation of Rights
Owner Approval?
**Master เซ็นได้เลย — มีอำนาจตามกฎหมายและประเพณีการเดินเรือ** ตาม Marine Insurance Act 2535 + International Convention on Salvage 1989 + Lloyd's Open Form 2020 Cl. 1: 'The Captain has full authority to bind owners and cargo interests.' **SCOPIC** = Special Compensation P&I Club Notary รับรอง: (a) Master's Signature + Vessel's Statutory Authority; (b) Time + GPS + Voyage Data Recorder Hash; (c) Apostille สำหรับ Lloyd's Arbitration Branch ใน London
General Average — Cargo Owner
**ตัวอย่าง Ever Given (Suez 2021)**: เรือเกยตื้น 6 วัน → Salvage Cost + Suez Canal Loss USD 916M → Cargo Owners ทุกคนใน 18,300 TEU จ่าย GA Contribution ตามสัดส่วน CIF Value.
P&I Club LOU — มีค่าใช้จ่ายไหม + ต่างจาก Bank Guarantee อย่างไร?
**LOU vs Bank Guarantee**: (a) **Cost**: LOU = USD 0 (รวมใน Club Call); BG = 0.5–2%/ปี + Collateral; (b) **Acceptance**: LOU ยอมรับใน Admiralty Court ส่วนใหญ่ (Singapore, UK, Hong Kong, US, Netherlands, Greece, Cyprus, Liberia, Panama, Marshall Islands) — แต่บางประเทศ (China, Brazil, Italy) ไม่ยอมรับ → ต้อง BG; (c) **Speed**: LOU ออกได้ภายใน 4–24 ชม. (Club's Authorised Signatory); BG ใช้ 3–7 วัน; (d) **Wording**: LOU มีมาตรฐาน Club Form 1 + 2018 Wording; BG ใช้ ISP98 / URDG 758 / Local Wording. **Top P&I Clubs (IG Group)**: Gard, Steamship Mutual, North Standard, UK Club, Britannia, Skuld, West of England, American Club, Japan P&I, China P&I, Shipowners Mutual, Standard Club, Swedish Club. Notary รับรอง LOU Specimen + Authorised Signatory Verification + Apostille
Death-Claim Affidavit — Beneficiary
**3 ทางเลือก**: (1) **Beneficiary บินมาไทย** เซ็นต่อหน้า Notary ไทย + ใช้ Passport + ID — ใช้เวลา 1 วัน, ค่าเดินทาง (เหมาะถ้า Claim > USD 500K); (2) **POA + Apostille** — Beneficiary ทำ POA ที่ประเทศตน + Notarise + Apostille → ส่ง Original มาไทย (DHL/FedEx 3–5 วัน) → Attorney-in-Fact (Family Member / Lawyer / Trustee) รับเงินแทน + Notary ไทยรับรอง Specimen Comparison; (3) **Remote Online Notarisation (RON)** ผ่าน Video Conference + e-Apostille — ใช้ได้กับประเทศที่รับ e-Apostille (US, UK, Germany, France, Singapore — 47 ประเทศจาก 127 HCCH). **เอกสารที่ต้องเตรียม**: (a) Death Certificate ทร.4/1 + Apostille ถ้าตายต่างประเทศ; (b) Birth Certificate / Marriage Certificate / Family Registration พิสูจน์ความสัมพันธ์; (c) Passport Beneficiary + Bank Account Statement; (d) Insurance Policy Original + Premium Receipts; (e) Tax Clearance (RC § 42(13) — Life Death Benefit Tax-Free). Notary รับรอง: Wet Signature + 2 Witnesses + Anti-Fraud Declaration + Suicide Clause Compliance + Apostille
WHT บน Insurance Payout — ทำไม Property Indemnity ไม่หัก แต่ Loss of Profit หัก?
**Cross-Border**: Foreign Insurer จ่ายเข้าไทย → ผ่าน BoT Authorised Bank + Form Tor.Tor.40 (FDI > USD 50K) + Beneficiary Declaration.
**5 ชั้น**: (1) **Claim Bordereau** — Schedule of Claims ภายใน Treaty Period (Quarterly / Monthly) + Loss Run; (2) **Cedant Statement** + Reinsurer's Scratch (Lloyd's Slip Form) — ยืนยันว่า Cedant จ่าย Claim แล้วและเรียก Recovery จาก Reinsurer ตาม Treaty Share; (3) **Loss-Adjuster Report + Underlying Policy Wording** — Reinsurer ใช้ตรวจ Coverage + Quantum; (4) **Reserves & Run-Off Statement** — IBNR + Case Reserves; (5) **Subrogation Recovery Account** — เงินที่ได้คืนจาก Recovery vs Tortfeasor (แบ่งตาม Treaty Share). **Reinsurance Treaty มี 4 ประเภท**: (a) Treaty Proportional (QS + Surplus); (b) Treaty Non-Proportional (XL + Stop Loss + Cat XL); (c) Facultative Proportional; (d) Facultative Non-Proportional. **Top Reinsurers**: Munich Re, Swiss Re, Hannover Re, SCOR, RGA, Berkshire Hathaway Re, Lloyd's Syndicate, PartnerRe, Everest Re, China Re, Korean Re, GIC India, Toa Re. **Dispute Forum**: ARIAS (US/UK), Lloyd's Syndicate Arbitration, SIAC, Bermuda Form, ICSID (Treaty Dispute). Notary รับรอง: Cedant Authority + Apostille + Sworn Translation

**Lawyer/Notary ห้ามทั้งหมด — Loss-Adjuster คิดได้ตาม OIC Regulation** เพราะ: (a) **Lawyer/Notary** อยู่ภายใต้ Lawyers Council Code § 11 + Notarial Attorney Regulation = ห้าม Contingency Fee / Success Fee / % of Claim เพื่อป้องกัน Conflict + Inflated Charge; (b) **Loss-Adjuster** อยู่ภายใต้ OIC Notification + Insurance Adjuster License — สามารถคิด **% ของ Claim** ได้ตามมาตรฐาน (ปกติ 5–15% ขึ้นกับ Complexity) — แต่ต้องประกาศกับ Insurer ก่อนแต่งตั้ง; (c) **Surveyor** (Lloyd's Agent, SGS, BV) คิดตาม Fixed Fee + Time + Expense; (d) **Salvor** (LOF 2020) คิดตาม Lloyd's Open Form 'Reasonable Reward' ตัดสินโดย Lloyd's Arbitration Branch (ไม่ใช่ % — แต่เป็น Award ที่อาจสูงถึง 50% ของ Salved Value). K. We prepare documents to the requirements of the receiving authority. Any approval decision remains at that authority's discretion.

These are illustrative composites of common medical-document workflows, not individual patient records, not medical advice, and not a guarantee of any hospital, insurer, or authority decision. Durations are approximate working-day ranges excluding institutional queues.

Claim files, medical certificates, police reports and certified translations accepted by foreign insurers.
Request the full record from the hospital's medical records unit, including admission notes, imaging reports and itemised billing. Everything is translated in full — partial translation is the single most common reason a claim stalls — and the translation is certified. Some insurers additionally want the treating physician's signature attested. Hospitals often take several working days to release records, so start that request before anything else.
Yes, and they are often the weaker link. Ask the station for a certified copy bearing the case number and officer's signature rather than a photocopy of your own. Translate it completely, including handwritten annotations and the diagram, because insurers compare the diagram with the damage assessment. Then apply the certification layer the insurer specifies. Allow extra working days if the report must be retrieved from an upcountry station.
Consistency across documents: the same dates, the same names and the same amounts in the police report, the medical or survey report, the invoices and the policy schedule. Translations must preserve those fields literally, including currency symbols and reference numbers. Adjusters read for contradictions first, so a file that reconciles on its face moves faster than one supported by more paperwork.
A police report where an incident was reported, medical records and certificates from the treating hospital, receipts and proof of payment, plus identity documents, each with a certified translation. Insurers frequently ask that the translation identify the translator and confirm completeness. Collect the originals before leaving Thailand, because hospitals and police stations are far harder to deal with once you are overseas.

It depends on the insurer. Many accept a certified translation alone, while others require attestation of the translation by the Department of Consular Affairs, and a few also require the hospital's authorised signatory to be identified. Ask which level applies before ordering, because the difference between a certified translation and a fully legalised set is several working days.
Medical translation disputes are usually resolved by returning to the source: a clean copy of the original record, the treating physician's clarification where available, and a revised translation preserving the clinical terminology rather than paraphrasing it. Avoid substituting a foreign diagnostic code for the words the physician wrote, because that substitution is what most often triggers the dispute in the first place.
