Marine Protest in Thailand: Evidence, Timing and Notary Requirements

Timing: keep the separate deadlines separate

• Contact the insurer or P&I correspondent and ship agent promptly with the incident and arrival times.
• Ask the intended recipient about the protest deadline and any extension; do not assume 24 hours or six months governs every case.
• Cargo notices, insurance notifications and time limits for proceedings are separate from executing the protest.
• If a relevant window has passed, disclose the actual chronology and obstruction to counsel. Never backdate a signature to make it appear timely.

Evidence to assemble before the appointment

• The draft account, declarant’s role, vessel particulars, port and intended recipient.
• Relevant deck and engine log extracts with time references and authors; retain the originals separately.
• Preserve relevant VDR, AIS and voyage data under the equipment instructions and evidence-preservation advice before it is overwritten.
• Damage photographs, weather information and witness accounts with their origins and unaltered source material.
• Relevant bills of lading, charterparty and policy particulars. Avoid circulating unrelated crew or commercial data.

Note of Protest, extension or survey?

The initial note records the declarant’s account. An extension may add a chronology, damage details or later findings, identifying the new information and its source. A survey report describes the surveyor’s examination within its agreed scope; a declaration is not a substitute for inspecting machinery or cargo.

• Check which signatories and which act the recipient requires: oath, affirmation, acknowledgment or signature witnessing.
• A protest does not automatically trigger insurance, shift the legal burden of proof or preserve every cause of action.
• General-average and salvage issues require their own contractual and claims documents.

Thai-port execution and overseas use

Ask the ship agent or adviser whether the recipient requires a Thai Notarial Services Attorney, flag-state consul or another authority. Port access and boarding depend on permissions and safety arrangements. Do not assume a permanent team at every port or round-the-clock boarding availability.

• Check the applicable Thai carriage law and contractual regime; do not simply substitute Hague-Visby wording for domestic law.
• At the review date, the Apostille Convention is not yet in force for Thailand. HCCH lists 28 February 2027 as its entry-into-force date.
• Until then, check legalisation and any embassy route with the recipient. After entry into force, check treaty relations, document eligibility and destination requirements.
• Legalisation or an Apostille does not decide the merits or require a court or insurer to accept the account as true.

Appointment and quotation: confirm the scope

• Provide the port, expected vessel availability, signatory, language and any deadline communicated by the recipient.
• Start with the requirements and a redacted draft; agree a suitable channel for the full evidence.
• Separate drafting, notarisation, translation, travel, access and authentication costs. A quotation should not be presumed to include a marine surveyor or litigation.
• Confirm actual availability and access before planning. A commercial turnaround statement is not a legal filing deadline.

When to stop and check the account

If a draft conflicts with logs or the proposed signatory disputes it, resolve the discrepancy while preserving the evidence trail. Do not invent events, backdate execution or substitute another person’s signature without a basis accepted by the recipient. Liability and coverage disputes need advice based on the actual contracts and records.
