Notarial signature witnessing (a.k.a. acknowledgment) is the service where a Notarial Services Attorney verifies the signer's identity with official documents (passport + address proof), watches the signature happen in person, then affixes the notarial seal. It is the most basic service in the notarial toolkit and a building block of nearly every cross-border document — from opening foreign bank accounts to signing parent-company resolutions for a US or Australian board.

Typical clients we see weekly: (a) **expats opening or closing foreign bank accounts** — HSBC HK, DBS Singapore, UBS Switzerland, ANZ AU, Lloyds UK, Standard Chartered request a notarised specimen signature + Apostille; (b) **foreign directors of Thai companies** signing board resolutions or annual returns for a parent company abroad; (c) **attorneys-in-fact in foreign litigation** — affidavits, witness statements, court-filing verification pages; (d) **passport-renewal applicants** at embassies that have closed their notarial counters (US Embassy since 2023 directs applicants to outside notaries); (e) **brokerage clients** at Interactive Brokers, Schwab, Tiger Brokers, Saxo who must produce a notarised W-8BEN; (f) **POA signers for foreign property** under CCC § 798 + destination law.

Our attorneys are Lawyers-Council-registered Notarial Services Attorneys (verify at /trust/credentials). In-office flow: (1) check passport + visa stamp + address proof (lease / utility bill / TM.30); (2) photo-ID capture with the signer (AES-256 encrypted); (3) confirm purpose, destination country, and the acknowledgment wording the destination requires (common-law: 'acknowledged before me'; civil-law: 'signed in my presence'); (4) witness the signing — including a thumbprint signature under CCC § 9 if the signer cannot read or write; (5) Notarial Register Book entry under Reg. 2546 § 20 (10-year retention, ISO/IEC 27001 backup); (6) notarial seal + attorney signature + register number; (7) forward to MFA for Apostille / authentication if needed. No contingency fees, and **never** an acknowledgment for a signer not physically present.

HCCH Apostille (entering into force in Thailand on 28 February 2027): Thai-notarised documents apostilled by MFA are accepted in 130 contracting states immediately — cutting embassy legalization from 7–14 days to 1–3 days and costs by 60–75%. Common destinations using Thai-notarised signatures: UK, AU, NZ, CA, SG, HK, JP, KR, DE, FR, IT, ES, NL, BE, US (Apostille-compatible states), UAE, India (Foreign Public Documents Act 1948).

Edge cases to watch

  • 🚨 POA for foreign condo / land transfer — must reference title deed and unit number under CCC § 798 — see /en/poa-specimen-signature-foreigner
  • 🚨 Corporate resolution where the parent is Delaware / BVI / Cayman — include the Apostille cover sheet required by the Secretary of State
  • 🚨 IRS W-8BEN — use the IRS-specific acknowledgment wording (the most-rejected item by banks in 2024–2026)
  • 🚨 Brokerage account closure — Interactive Brokers asks for a Medallion Signature Guarantee, which Thailand cannot issue; we route via a notarised affidavit + Apostille
  • 🚨 Multi-signatory documents with signers abroad — use a notary in that country, with the foreign apostille
  • 🚨 Embassy forms that require a US notary specifically — US Embassy Bangkok still offers notary by appointment
  • 🚨 Signers unable to read or write — thumbprint signature + 2 disinterested witnesses under CCC § 9

Risk shields — what we never do

  • ❌ Never acknowledge a signature for a signer not physically present (Reg. 2546 § 20 + Penal § 264 forgery up to 3 years)
  • ❌ Never backdate (Reg. 2546 § 19 — licence revocation risk)
  • ❌ Never witness for an undisclosed third party (PDPA § 26)
  • ❌ Never proceed where AML / fraud red flags appear — file STR under AMLA § 13
  • ❌ Never use machine translation for attached documents (ISO 17100 TEP only)
  • ❌ Never accept a contingency fee (Ethics § 11)
  • ❌ Never skip the two-factor identity check (passport + address proof) under AMLA § 16

Workflow verification — what we double-check for you

  • Passport validity ≥ 6 months + visa status matches TM.6 / TM.30
  • Thai address proof — lease / utility bill / bank statement / TM.30 (≤ 3 months)
  • Acknowledgment wording matches destination practice (US: 'subscribed and sworn' / UK: 'signed in my presence' / civil-law: 'signed before me')
  • Initials on every page + no blank pages + no un-initialled strike-throughs
  • Notarial Attorney licence number + MFA Apostille number both verifiable online
  • Notarial Register Book retained 10 years (Reg. 2546 § 20) + ISO/IEC 27001 backup

Frequently asked questions

How is signature witnessing different from a certified true copy?

Signature witnessing means the attorney sees the signature happen and certifies the signer's identity. A certified true copy is the attorney comparing a copy to its original and certifying they match. They are separate services; some documents need both (e.g. certified copy of passport + notarised signature on a bank form).

In-person or online?

In-person only. Remote Online Notarization (RON) is not yet recognised in Thai law (unlike US Florida / Virginia or Singapore's Notarial Acts Bill 2023). We offer a Bangkok office plus nationwide travel notary.

Will HSBC HK / DBS SG / UBS Switzerland accept it?

Yes — these banks accept Thai-notarised specimen signatures with MFA Apostille (HCCH (in force for Thailand 28 February 2027)) from 28 February 2027, cutting turnaround from 14 days to 3. Some (UBS Wealth) ask for bilingual wording; we add it free.

Can I notarise IRS W-8BEN in Thailand?

Yes — a Thai notarial attorney qualifies under W-8BEN instructions (Rev. Oct 2021) using the IRS-specific acknowledgment wording + MFA Apostille for brokerages in Apostille jurisdictions.

Is signature witnessing enough for a foreign-property POA?

No — a POA must be drafted under CCC § 798 + destination law with title-deed / unit references and a defined scope. We handle this separately at /en/poa-specimen-signature-foreigner because of the higher liability and required drafting review.

What do I prepare for a Delaware-parent corporate resolution?

(1) original resolution draft (English); (2) board composition + share register of the parent; (3) director passport + visa; (4) Delaware Secretary of State Apostille cover sheet. We pre-check everything before booking. Same-day Apostille quote on request (phone / LINE / email).

Signer can't read or write — can they thumbprint?

Yes — CCC § 9 + Reg. 2546 § 22: right-thumb print + 2 disinterested witnesses, with the attorney reading the document aloud before sealing. Banks and embassies accept it.

What does upcountry travel notary cost?

Notary fee unchanged + travel by distance (BKK metro quote on request (phone / LINE / email); Phuket / Chiang Mai / Pattaya quoted on request incl. travel + 1 night). Book 3 business days ahead.

How is personal data protected?

PDPA § 24 (general) + § 26 (sensitive where applicable) — ISO/IEC 27001 servers in Thailand, AES-256 + HSM, TLS 1.3, MFA + biometric login, audit log, 10-year retention (notarial standard), PDPC-registered DPO — data rights: dpo@notary.co.th.

Free consult? What do I send?

Yes. LINE us: (1) passport bio; (2) draft document; (3) destination country + authority; (4) deadline. Within 1 business day you get a fixed-fee quote + checklist + booking slot. Lawyer-client privilege from the first message, no consult fee, no obligation.

What if an attorney certifies a signature from someone not present?

Violates Reg. 2546 § 20 — licence revocation by the Lawyers Council, plus forgery under Penal § 264 (3 years) and § 268 (use of forged document, 3 years). **We refuse such requests at any price.**

Document and legalization advisers with 15+ years of practice

We advise throughout the matter, not just process paperwork

Before we start, we read your actual documents and confirm the legalization route matches what the receiving authority asks for. During the work we report progress, and after delivery we still answer questions about how to submit the file.

Before we start — document risk review

  • Check that names, dates and document numbers match across every page
  • Confirm whether the receiving body needs originals, certified copies or digital files
  • Tell you early if a document must be reissued or re-extracted first

While the matter runs — filing and status updates

  • Report which step is in progress with working-day estimates
  • Respond immediately when an authority requests extra documents
  • Confirm official fees before each filing step

After delivery — support until the file is usable

  • Explain how to submit the file to the destination authority or embassy
  • Keep a copy on record so extra sets can be issued later
  • Answer follow-up questions when the destination asks for supporting papers

We prepare documents to the requirements of the receiving authority. Any approval decision remains at that authority's discretion.

Send your documents on LINE for a preliminary review, a recommended legalization route and a written quote.

How is personal data in my documents handled?
Documents are used only for the purpose you state, retained for the period professional duties and data-protection law require, and not disclosed to third parties without consent.
When was this page last reviewed?
Each page shows its last-reviewed date in the sources section. Authority requirements change, so confirm current conditions with the receiving authority before proceeding.
What is the fastest way to reach you?

Where do I start if I am unsure which certification I need?
Start with three questions: which authority will receive the document, in which country, and by what date. Those answers determine the authentication route, the translation language and the full sequence.
