Signature execution for overseas documents

Signature Witnessing in Thailand: Check Before You Sign

Does your bank, company or overseas recipient want a witnessed signature, an acknowledgment or a sworn statement? Check the execution block before signing so the certificate records the right act—not simply an available stamp.

The wording beside the signature matters. “Signed in my presence” is not the same as acknowledging an existing signature, and neither automatically replaces a sworn or affirmed statement. If the required act is witnessing, an attorney must not claim to have seen a signature made before the appointment.

A genuine signature and authority to sign are separate issues. A director can sign personally without the document establishing that the company authorised that transaction. A witnessed signature does not replace a board resolution or power of attorney where the recipient requires one.

Before execution

Identify the act in the execution block

  • Signature witnessing: confirm whether the recipient requires the signing to occur before the witness.
  • Acknowledgment: check the required declaration about an existing signature and voluntary execution.
  • Jurat, oath or affirmation: an additional sworn or affirmed act, not just signature witnessing.
  • Certified true copy: comparison of a copy with its original, a separate service.
  • Medallion Signature Guarantee: a financial signature guarantee, not an ordinary notarial certificate.

Prepare for the actual signers and document

  • Obtain the current form and instructions from the recipient, including the country and institution.
  • Bring a valid original identity document; disclose any name discrepancy with linking evidence.
  • For company execution, ask which corporate records, resolutions or authority documents are needed.
  • Count the signers, documents and signature or initial blocks rather than assuming every page needs a stamp.
  • Explain any language, interpretation or accessibility needs before booking.

Already signed, or signing in different countries?

Describe a pre-signed document honestly. The recipient may require a clean copy and fresh signing, or may accept an acknowledgment under its rules. Do not backdate the certificate or ask a witness to describe an earlier signature as one made in their presence.

For multiple signers, ask whether counterparts or separate certificates are permitted. Each certificate must describe the act actually performed for that signer; one person’s certificate cannot be copied across to cover someone else.

W-8BEN: separate IRS instructions from bank policy

The IRS W-8BEN instructions require the form’s certification and signature under penalties of perjury; they do not impose a general notary requirement on every W-8BEN. If a bank or withholding agent asks for additional certification, obtain that institution’s written instructions rather than describing it as a universal IRS rule.

If the recipient requests a Medallion Signature Guarantee, ask about an eligible participating financial institution. Ordinary notarisation or an Apostille is not an automatic substitute for that guarantee.

Consular alternatives and further authentication

Some recipients require a consular officer or another specified category of witness. The U.S. Embassy in Thailand publishes notarial service information; it is incorrect to state that it has stopped all notarial services. Check appointments, document restrictions and current instructions directly.

Thailand’s Apostille Convention entry into force is 28 February 2027 according to HCCH. Before that date, verify the current legalisation route. After entry into force, check the treaty relationship and document scope. An Apostille authenticates origin, not the underlying statements, corporate authority or a bank’s acceptance decision.

Ask for a document-specific scope

Send the execution block, recipient instructions, number of signers, destination and deadline, redacting unrelated personal data in an initial enquiry. Request separate scope for witnessing, copy certification, translation and legalisation if needed. Do not assume that every step, travel service or a fixed turnaround is included.

Questions before booking

How is witnessing different from a certified true copy?

Witnessing concerns a signing act. Copy certification concerns comparison with an original document. A recipient may require either or both; check its checklist first.

Can a witness certify a signature I made before attending?

Not as a signature made in that witness’s presence. Explain the situation and check whether fresh execution or an eligible acknowledgment is required. The certificate must not invent or backdate an event.

Will every overseas bank accept a Thai notarial certificate?

No universal acceptance should be assumed. Ask the team reviewing the document about eligible certifiers, certificate wording, originals and further authentication before booking.

Does W-8BEN always need notarisation?

No general notary requirement appears in the IRS instructions cited here. Additional requests from a bank or withholding agent are a separate policy to confirm with that institution.

Can notarisation replace a Medallion Signature Guarantee?

They are different services. Do not substitute a notarial certificate without the recipient’s express approval; ask about a financial institution eligible to provide the required guarantee.

What if I cannot understand the document’s language?

Explain this before the appointment so translation, interpretation and the recipient’s execution requirements can be assessed. Do not sign without understanding the contents or assume a thumbprint is valid for every destination.

Document and legalization advisers with 15+ years of practice

We advise throughout the matter, not just process paperwork

Before we start, we read your actual documents and confirm the legalization route matches what the receiving authority asks for. During the work we report progress, and after delivery we still answer questions about how to submit the file.

Before we start — document risk review

  • Check that names, dates and document numbers match across every page
  • Confirm whether the receiving body needs originals, certified copies or digital files
  • Tell you early if a document must be reissued or re-extracted first

While the matter runs — filing and status updates

  • Report which step is in progress with working-day estimates
  • Respond immediately when an authority requests extra documents
  • Confirm official fees before each filing step

After delivery — support until the file is usable

  • Explain how to submit the file to the destination authority or embassy
  • Keep a copy on record so extra sets can be issued later
  • Answer follow-up questions when the destination asks for supporting papers

We prepare documents to the requirements of the receiving authority. Any approval decision remains at that authority's discretion.

Send your documents on LINE for a preliminary review, a recommended legalization route and a written quote.

Related questions

How is personal data in my documents handled?
Documents are used only for the purpose you state, retained for the period professional duties and data-protection law require, and not disclosed to third parties without consent.
When was this page last reviewed?
Each page shows its last-reviewed date in the sources section. Authority requirements change, so confirm current conditions with the receiving authority before proceeding.
What is the fastest way to reach you?
Call or message on LINE during business hours for an initial route check, and send legible photos of the documents by email or LINE so the scope can be assessed accurately.
Where do I start if I am unsure which certification I need?
Start with three questions: which authority will receive the document, in which country, and by what date. Those answers determine the authentication route, the translation language and the full sequence.
