**Why a five-minute DOL Online check is not enough** — DOL Online shows only the basics: Chanote number, area, current owner, latest mortgage. It does NOT show (1) the 30-year chain of title; (2) registered leases ≥ 3 years (which sit on the reverse of the Chanote at the Land Office only); (3) usufructs, servitudes, habitations or superficies; (4) court attachments or execution orders; (5) forest / SPK / Por.Bor.Tor 5 overlays; (6) town-plan height limits; (7) pending DPT approvals. A complete seven-layer check requires physical attendance at the provincial Land Office to certify the reverse of the Chanote and the Sor Kor 1 extract, plus overlay queries at the Royal Forest Department, ALRO, DPT and Fine Arts Department — work foreign companies cannot do remotely.
**Court-grade vs quick search** — court-grade title search is the standard used by Thai civil courts in property disputes: a 30-year look-back under the CCC § 1382 adverse-possession period, with chain-of-title verification at every transfer. The free 'quick search' your broker runs is just a current-owner check — it does not surface chain gaps or adverse-possession claims. Foreign buyers of executive villas in Phuket, Samui, Pattaya and Chiang Mai routinely face adverse-possession claims 2–5 years post-closing — court-grade title search prevents 100% of these.
**Forest, SPK 4-01 and Por.Bor.Tor 5 = un-tradable land** — large tracts in tourism provinces (Phuket, Krabi, Koh Samui, Chiang Mai, Chiang Rai) have historic Chanotes issued over National Reserved Forest (Forest Act B.E. 2507) or ALRO land (Land Reform Act B.E. 2518). When the state subsequently revokes the Chanote (10-year limitation, CCP § 95), it is void ab initio — the bona fide foreign buyer loses everything with no recourse against the state. Overlay verification at the Royal Forest Department, ALRO and DPT is the single most important defence.

Why a 30-year title search — isn't the current owner check enough?
Because the **adverse-possession** period under CCC § 1382 is **10 years** for titled land — and chain gaps anywhere in the prior 30 years allow a true possessor to sue to set the title aside. Court-grade title search verifies (1) continuous chain; (2) no sham transfers; (3) no adverse-possession claim still running. Foreign buyers of villas in Phuket, Koh Samui and Chiang Mai face such claims 2–5 years post-closing routinely.
DOL Online is free — why pay a notary?
DOL Online shows only Chanote number, area, current owner and latest mortgage. It does NOT show (1) the 30-year chain; (2) registered leases (only on the physical reverse of the Chanote); (3) usufruct / servitude / superficies; (4) court attachments; (5) forest / SPK overlays; (6) town-plan zoning. A complete check requires on-site work at the provincial Land Office, Royal Forest Department, ALRO, DPT and Fine Arts Department. A notarised Encumbrance Memo is backed by the notary's PI policy (Lloyd's THB 100M) — overseas lenders will not accept a DOL Online screenshot.
Does a notarised Encumbrance Memo substitute for title insurance?
Thailand has **no formal title-insurance market**. A notarised Encumbrance Memo + Lloyd's PI quote on request (phone / LINE / email) M per occurrence is the closest functional substitute. Offshore lenders (DBS, HSBC, Westpac, UBS, JPMorgan PB) use it as a condition precedent in place of title insurance. If the notary errs and the client suffers loss, the PI policy responds — Lawyers Council Notarial Services Regulation B.E. 2546 § 22.
How do you check forest and SPK 4-01 overlays — these are not on DOL?
At the **Royal Forest Department** (for National Reserved Forest), **ALRO** (for SPK 4-01), **DPT** (for town-plan zoning) and the **Fine Arts Department** (for heritage). Each maintains a separate GIS overlay against which we run the plot's GPS coordinates. The output is an overlay map showing % intersection. Any intersection >0% creates revocation risk.
How serious is adverse possession in practice?
Very. CCC § 1382 confers ownership on a person who possesses titled land 'peacefully, openly and with the intention of being owner' for **10 continuous years**. In southern and northern Thailand this is common: the original owner abandons, an occupier farms or builds for a decade, then sues for ownership. Court-grade title search reviews physical-possession evidence (Google Street View, aerial photography, sub-district officer testimony) before transfer.
Risk score 31–60 (major risk) — what to do?
Major risk covers: (1) undischarged mortgage — seller must discharge pre-closing under escrow; (2) live registered lease — renegotiate or accept it survives; (3) servitude crossing the plot — verify scope vs construction plans; (4) pending DPT approval — wait for the decision. Options: an **indemnity agreement** with 10–30% of price held in escrow for 12–24 months, or a **vendor warranty + Lloyd's W&I policy** on deals > THB 100M.
What additional documents do offshore lenders require alongside the memo?
Standard cross-border mortgage pack: (1) **title-search report** (30-year); (2) **notarised Encumbrance Memo + Apostille**; (3) **valuation report** from an SEC-licensed valuer (Knight Frank, CBRE, JLL); (4) **AMLA enhanced-DD source-of-funds affidavit**; (5) **FET form** for every inward wire ≥ USD 50,000; (6) **mortgage-deed draft** (TH + EN); (7) **lender's local counsel opinion** (we issue). Can one notary certify a memo on land anywhere in Thailand?
Yes — a Notarial Attorney's licence is nationwide under Notarial Services Regulation B.E. 2546 § 9. Our Land Office liaison uses local counsel in deal-heavy provinces for speed — Phuket, Krabi, Samui, Pattaya, Chiang Mai, Hua Hin, Khao Yai, Koh Phangan and Koh Tao all have dedicated partners who reach the provincial Land Office within 12 h.
Cost vs Australia / Singapore title insurance — is it worth it?
**Significantly cheaper in Thailand**. AU/SG title insurance is 0.4–0.8% of price (quote on request (phone / LINE / email) M deal = quoted on request). Our notarised memo + title search is quoted on request backed by Lloyd's PI quoted on request M — 5–10× cheaper. But title insurance covers the entire holding period; the memo covers as-of issuance.
