I have no religion — can I use Affirmation instead of Oath?
Yes, with identical legal effect under Lawyers Council Reg. 2546 § 18. The wording becomes 'I solemnly, sincerely and truly affirm…' instead of 'I swear by Almighty God…'. US/UK/AU/EU destinations accept Affirmation universally.
Can I swear via Zoom or video call?
No. Reg. 2546 § 19 requires the oath to be administered in the physical presence of the Notarial Attorney. Remote Online Notarization (RON) has no legal effect in Thailand as of June 2026. If the declarant is overseas, either travel to Thailand or use a Notary Public in your country + Apostille + Thai translation.
What are the penalties for false swearing?
Thai Penal § 177 (false oath) up to 7 years + fine; § 137 (false statement to officer) up to 6 months; § 264 (forgery) up to 3 years; § 268 (use of forged document) up to 3 years. Destination-country penalties may add (US 18 USC § 1621 perjury up to 5 years; UK Perjury Act 1911 up to 7 years).
