Thailand has received CRS data since the September 2023 first exchange. The TRD now sees foreign balances, interest, dividends, and gross proceeds. False self-certification = Revenue Code § 37bis (up to 7 years imprisonment) + foreign-bank account closure.
What CRS sends to Thailand each year
**Account holder identifiers:** Full name, address, TIN, date of birth.
**Account data:** Account number, year-end balance (31 December), gross interest, gross dividends, gross proceeds from sale of financial assets, custody and depository fee charges.
**Reporting countries:** 120+ CRS partners, including all EU states, UK, Singapore, Hong Kong, Switzerland, UAE, and Australia. Notable non-CRS: USA (uses FATCA instead) and a small number of opt-out jurisdictions.
FATCA — the parallel US channel
Thailand signed an IGA Model 1 with the US in March 2016. Thai banks report on US-person account holders via the TRD to the IRS. The reverse flow (US-to-Thailand on Thai-person accounts in the US) is limited under the asymmetric Model 1.
Practical consequence: dual US-Thai persons see their Thai accounts reported to the IRS, but their US accounts are NOT automatically reported to the TRD. Reconciliation relies on FBAR/8938 disclosures and voluntary remittance reporting in Thailand.
Filling the self-certification — the four trap fields
**1. Tax residency.** If you crossed 180 days in Thailand, you ARE a Thai tax resident regardless of where your domicile is. Ticking only 'US' or only 'UK' when you live in Bangkok is a false declaration.
**2. TIN.** Thai TIN is the 13-digit PIN issued by the Revenue Department. Foreign-bank forms often have a 'no TIN' tick-box — use it only if you legitimately do not yet have one.
**3. Entity classification.** Passive NFE vs Active NFE matters: a personal investment holding company is Passive and triggers look-through to the controlling person.
**4. CRS controlling person.** For trusts and family-investment companies, you must name the controlling natural person. False naming = AML offence.
Reconciling CRS data with your PND.91
The TRD's AEOI unit cross-matches CRS reports against your PND.91 declared remittances. A foreign year-end balance increase that exceeds declared foreign income raises an automated enquiry letter.
Common false positives: capital injections from pre-2024 wealth (Paw.162 exempt) or transfers between your own accounts. Keep MT103 reference letters from your foreign bank — they are the cleanest proof in any audit.
When the TRD opens an enquiry, you have **15 days** to respond (Revenue Code § 19). Engaging a Notarial Services Attorney early lets you serve the response in Thai with certified-translated supporting documents in one filing.

Does opening an LTR-related Thai bank account trigger CRS in Thailand?+
Yes — Thai banks self-certify their account holders to Thai TRD for outbound exchange to your other CRS-reportable jurisdictions. There is no escape from CRS by choosing Thailand.
I forgot to declare remittances in 2024. What is the cleanest fix?+
File an amended PND.91 voluntarily (Revenue Code § 22) — the 100 % surcharge is reduced to ≤ 50 % if filed before a formal assessment. Criminal liability under § 37bis is generally waived for voluntary corrections. Engage counsel before filing.
Are crypto exchanges CRS-reportable?+
From the 2026 reporting year, CARF (Crypto-Asset Reporting Framework) extends CRS-style automatic exchange to most regulated exchanges. Thailand has not yet adopted CARF but BOT/SEC Thailand are consulting in 2026.
