TL;DR
e-APP = HCCH standard for electronic Apostille with two pillars: (1) e-Apostille = PDF carrying a Qualified Electronic Seal at PKI Class 4 issued by DCA, (2) e-Register = online lookup of any Apostille serial 24/7. Thailand launches Q4 2026, with eIDAS-2 (EU Reg. 2024/1183) interop from 2027. Lead time collapses 1–2 days → 1–2 hours. Fee unchanged quote on request (phone / LINE / email). Requires the source document to be digital-native (PDF/A) with the Notarial Services Attorney's PAdES e-signature.
What e-APP actually is
The HCCH **e-APP (electronic Apostille Programme)** is an optional Convention extension introduced via the **2003 Conclusions and Recommendations** of the Special Commission and progressively updated. Today 50+ Contracting Parties run an e-Register; 35+ also issue e-Apostilles.
**Two technical pillars:**
• **e-Register** — an online lookup tool where a receiver enters the Apostille serial number and instantly sees the metadata: issuer, date, document hash. Most parties launch this first because it requires no signature infrastructure on the receiver side.
• **e-Apostille** — a PDF Apostille embedded with a Qualified Electronic Seal (QES) issued under the Competent Authority's PKI. The receiver verifies offline using a public PKI certificate.
**Thailand:** committed to launching both pillars together by Q4 2026 per the DCA Digital Roadmap (Jan 2026 draft).
The DCA PKI architecture (per draft roadmap)
**Root certificate authority:** Thailand National Root CA (Thailand NRCA) — under ETDA per ETA B.E. 2544.
**Intermediate CA:** Department of Consular Affairs Issuing CA — limited to DCA officers + Notarial Services Attorneys who have completed PKI enrolment.
**Signature format:** PAdES-B-LTA (PDF Advanced Electronic Signature — Long-Term Archival), conforming to ETSI EN 319 142 + EU eIDAS Annex II.
**Hash chain:** the e-Apostille hashes the source PDF/A; any subsequent modification to the source invalidates the seal.
**Validity:** signature remains verifiable for 10 years from issue under LTA grade — extendable indefinitely via re-stamping.
What changes for the Notarial Services Attorney workflow
**PKI enrolment (one-time):** notary attends an ETDA-accredited Registration Authority in person, presents Lawyers Council ID + government ID, receives a hardware token (smart card or HSM-backed USB) holding the private key. Cost: ~quote on request (phone / LINE / email)/year renewal.
**Document preparation:** source document drafted as PDF/A-3 (embedded fonts, no JavaScript, no external references) — Microsoft Word / LibreOffice with the PDF/A export option meets this.
**e-signature:** notary inserts a visible signature field, signs with the PKI token using a PAdES-compliant tool (Adobe Acrobat Pro, JSignPdf, DocuSign with QES profile).
**Submission to DCA:** upload via DCA e-Apostille Portal; DCA officer verifies notary's seal against the PKI directory, applies the DCA e-Apostille seal, returns the sealed PDF + e-Register entry within 1–2 hours.
**Delivery to receiver:** PDF attached to email. Receiver verifies (a) by opening in Adobe Reader (green check) or (b) by visiting the DCA e-Register portal with the serial number.
eIDAS-2 interoperability (EU Regulation 2024/1183)
**eIDAS-2 (in force 20 May 2024)** modernised the EU trust framework, introducing the European Digital Identity Wallet + cross-border trust-service interoperability via the EU Trusted Lists machinery.
**HCCH e-APP × eIDAS-2 nexus:** a Thai DCA e-Apostille carrying a QES whose root anchors in a trust list mutually recognised by the EU Commission will be auto-trusted by EU receivers (banks, courts, registries) without manual signature verification.
**Bilateral or unilateral?** HCCH Permanent Bureau and DG-CONNECT are negotiating multilateral inclusion; Thailand can also pursue bilateral trust-list inclusion with individual Member States in the interim.
**Practical milestone:** by 2027 Thai e-Apostilles should pass eIDAS validation on the first attempt at the EU Commission's free online validator (https://ec.europa.eu/tools/lotl/eu-lotl-pivot.xml).
Strategic implications for cross-border filers
**Lead-time collapse:** 1–2 working days → 1–2 hours for the Apostille step itself. Combined with online notarisation (when codified in Thailand) the whole chain could be ≤ 1 hour from request to delivery.
**Audit-trail strength:** PAdES-LTA signatures are forensically robust — invaluable in cross-border litigation where document authenticity is itself the contested issue.
**Cost-neutral:** THB 200–400 fee unchanged in the 2026 fee schedule. No premium charged for e-format.
**Backward compatibility:** physical Apostilles remain available indefinitely for receivers without digital infrastructure (most non-HCCH destinations, some emerging-market receivers).
คำถามที่พบบ่อย
Will an e-Apostille be accepted in a paper-based court filing?+
Yes — print the e-Apostilled PDF; the receiver can verify online via the e-Register serial number. Most national courts (US Federal Rules of Evidence 902(12), German ZPO § 437a, English CPR 32.19) treat verified e-Apostilles as self-authenticating.
Can I notarise + e-Apostille a Thai-language document only?+
Yes. The Apostille only authenticates the issuance, not the content. The receiving authority may still request a certified translation — which itself can be separately notarised + e-Apostilled, or bound with the source under one Apostille.
What happens if my PKI token is lost or stolen?+
Immediately revoke at the ETDA-accredited RA. Documents notarised + e-Apostilled before the revocation date remain valid (the LTA timestamp preserves the chain of trust). Replacement token + re-enrolment: quote on request (phone / LINE / email).
Does e-APP replace the physical DCA Apostille?+
No — both formats coexist. The applicant or the receiver chooses. Most law firms with international practices will default to e-Apostille within 12 months of launch; small-volume domestic users may continue with physical stamps for years.
How does e-APP affect HCCH 1965 Service Convention work or 1970 Evidence Convention work?+
It doesn't directly — those are separate Conventions with their own designated authorities. But e-Apostille streamlines the supporting documents (POA, court orders) commonly transmitted alongside Service requests. Thailand is also a party to the 1965 + 1970 Conventions (since 2010 / 2018 respectively).
